Information in accordance with Articles 13 and 14 of the General Data Protection Regulation (GDPR) for CLAAS customer satisfaction surveys

CLAAS U.K. Ltd. processes personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR). Below, CLAAS provides information about the processing of customer personal data by CLAAS and about customer rights.

3. Which sources and data does CLAAS use?
CLAAS only processes the personal data that CLAAS obtains from you as the customer as part of the customer satisfaction survey and/or in the delivery advice for the machine. Relevant personal data includes your personal details (name, address and other contact details), your customer number at CLAAS, the machine number and designation, the handover date of the machine, the sales partner no., your complaints and suggestions for improvement. Information regarding an agricultural machine is also of a personal nature when it refers to a natural person, for example the driver or owner of the agricultural machine. If you fill out the survey online using the link provided, the data will also be processed using cookies. You can find more information about this under Item 6 "Cookies".
4. Why does CLAAS process customer data (purpose of processing) and on what legal basis?
The processing of data is based on your consent to the processing of your personal data for advertising purposes in accordance with Art. 6(1a) GDPR which you provided when the machine was handed over or at a later time. In addition, your data will be used to conduct and process the customer satisfaction survey, for the quality assurance of our products, to improve products and services, e.g. by offering you additional driver training or additional customer service, for market analyses and for the purposes of direct advertising. The legal basis for this is Art. 6(1f) GDPR. Our legitimate interests are to provide you – the customer – with a means to express criticism and submit complaints so that we can adapt our products and services accordingly.
5. Who is given access to customer data?
At CLAAS, access to customer data is only given to those persons who require access in order to conduct and process the customer satisfaction survey and handle complaints management. CLAAS works together with service providers to conduct the customer satisfaction survey in order to collect, use, analyse or process in any other manner personal data in the name of CLAAS. These are companies in the categories of market research institutes, IT services and telecommunications. Service partners who support CLAAS in the processing of your customer complaints are also given access to this data. Further data recipients include members of the CLAAS service organisation (the service partners selected by the customers and the responsible CLAAS sales company). Through agreements on commissioned data processing, we have ensured that these service providers acting on our behalf are obliged to follow instructions and guarantee the security and confidential handling of your data.
6. Cookies
CLAAS uses cookies on its website. Cookies are small text files which are stored on your computer via your Internet browser. Cookies are often used to make a website more user-friendly and more effective. CLAAS uses "session cookies", which are deleted when you end your browser session. Most Internet browsers are set in such a way that they automatically accept cookies. However, you may deactivate storage of cookies or set your Internet browser in such a way that it informs you as soon as cookies are sent. User data is analysed on the basis of the first sentence of Art. 6(1f) GDPR. CLAAS' interest, within the meaning of the first sentence of Art. 6(1f) GDPR, is the operation of this website.

7. How long will the data be stored for?
The data collected in this customer satisfaction survey and in any log data will be erased when it is no longer required to process a customer complaint. Otherwise, the data will be anonymised after no later than 12 months after the survey has been conducted.
8. Will data be transferred to third countries or international organisations?
Data will only be transferred to third countries (countries outside the European Economic Area ‒ EEA) if this is necessary in order to follow up on any customer complaint (e.g. data transfer to your service partner if the latter has its registered office outside the EU or the EEA) or if you have given your consent to this. If necessary, CLAAS will use appropriate guarantees to ensure a sufficient level of data protection. This includes, but is not limited to, the standard contractual clauses approved by the European Commission or comparable contractual clauses in other legislation. Other guarantees can be waived in exceptional cases, if you provide your consent. The European Commission has identified certain third countries as safe third countries, which means that in these countries too CLAAS can omit appropriate guarantees. Furthermore, no personal data will be transferred to third countries or to any international organisations.
9. What data protection rights do I have?
You have the right to obtain information about your personal data that we hold in accordance with Art. 15 GDPR. If data relating to you is incorrect or no longer current, you can request that this is corrected in accordance with Art. 16 GDPR. Furthermore, in accordance with Articles 17 and 18 GDPR, you can request that your personal data is erased or subject to restricted processing. In addition, you can exercise your right, as per Art. 20 GDPR, to the disclosure of the personal data provided by you in a commonly used machine-readable format (right to data portability). In accordance with Art. 21 GDPR, you have the right, for reasons resulting from your particular situation, to object to the processing of the personal data relating to you at any time in accordance with Art. 6(1f) GDPR. The controller will cease processing the personal data relating to you unless they can provide compelling reasons for doing so which outweigh your interests, rights and freedoms, or unless the processing is used to assert, exercise or defend legal claims.
If your personal data is processed for the purpose of direct advertising, you have the right to lodge an objection to this processing of your personal data at any time. We will then cease processing your personal data for such purposes.
Furthermore, you also have the right to withdraw your declaration of consent required under data protection law at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
You can assert these rights informally, e.g. by using the contact details provided under paragraph 2.
In addition, you can contact a data protection authority and submit a complaint with them.
10. Is the customer obligated to provide data?
There is no legal or contractual obligation to provide personal data. However, you cannot participate in the survey without providing data. This data is needed for participation in the survey and for the subsequent evaluation, including following up on individual customer complaints.
11. To what extent does automated decision-making take place?
No fully automated decision-making and no profiling is used to conduct the customer satisfaction survey in accordance with Art. 22 GDPR.
